This Safety, Location Tracking, and SOS Policy ("Policy") details our commitment to secure experiences, mandatory/optional location sharing, and emergency response on the MargoGuide Platform. By using the Platform, you consent to these measures (where applicable), as incorporated into the Traveller Terms & Conditions and Guide Onboarding Agreement.
Important Notes: - All users must be 18+. Guides undergo KYC verification. - Location data is used solely for safety and retained per Privacy Policy (precise data: 30 days, then deleted/anonymized). - Report incidents via in-app tools or support. Investigations use booking/chat/location logs. - Platform not liable for third-party actions; users responsible for personal safety. - Assumption of Risk and No Insurance: You acknowledge that travel and experiences involve inherent risks, including but not limited to personal injury, property damage, or health issues. The Company provides no insurance coverage for you, Guides, or third parties. You are responsible for obtaining your own travel insurance and assuming all risks associated with using the Platform or participating in Guide offerings. - The Company disclaims liability for third-party services; use at your own risk. Complies with DPDP Act, IT Rules, 2021, Personal Data Protection Bill, 2019 (superseded). - The Company may exercise admin override to access location data or intervene in real-time for safety and integrity purposes.
LOCATION TRACKING To enhance safety during active trips: - Guides (Mandatory): Enable live location tracking from trip start to completion. Accessible only to Platform admins/support via secure admin app. Non-compliance may suspend Guide status. - Travellers (Optional): Share live location with Guide consent (toggle in booking screen). Intended for coordination; revocable anytime. - Data Handling: Collected via device GPS; retained 30 days for safety reviews, then anonymized/deleted. Compliant with data minimization principles. No sharing with third parties except law enforcement. - Guide live location tracking is mandatory during active trips; accessible to admin/support via admin app for safety. - Traveller live location sharing is optional; enabled with Traveller consent. - Location tracking is intended for safety. Location data retention: precise location retained for 30 days, then deleted/anonymized. Under DPDP Act, location is processed with verifiable consent (Section 6) for specified purpose (safety), with data minimization.
SOS FEATURE In emergencies: - Trigger SOS: As Traveller, tap SOS button during trip (in booking screen). Add optional message and/or location. - Response: Creates instant record; alerts admin/support workflow for immediate follow-up (e.g., contact authorities, Guide notification).
- No Cost: Free feature; logs retained for 12 months (per Privacy Policy). - Abuse: Misuse (e.g., false alarms) may lead to account review/suspension. - Traveller can trigger SOS during trip; optional message + optional location. - SOS creates a record and alerts admin/support workflow for follow-up. - Guides must respond promptly to Traveller SOS (alerts support). Cooperate in investigations.
GENERAL SAFETY GUIDELINES - Pre-Trip: Review Guide profiles (ratings, verification badges). Use in-app chat for coordination. - During Trip: Stay aware; optional features like trip reminders and meeting point sharing. - **Prohibited Conduct: Harassment, unsafe activities, or off-Platform dealings violate Community Guidelines. - Platform Monitoring: Admins monitor for risks; may intervene (e.g., end trip, suspend users). - Foreign Travellers: Comply with local laws (e.g., visa, permits). Platform provides general advisories but not legal advice. - You agree to use the Platform responsibly and report issues promptly.
LIABILITY AND DISCLAIMERS - Platform facilitates connections but is not a party to Traveller-Guide services. - Use at own risk; we disclaim liability for injuries/losses (to extent permitted by law). - In SOS cases, we assist but response times vary.
GOVERNING LAW AND DISPUTE RESOLUTION Governed by laws of India. Disputes subject to exclusive jurisdiction of courts in Vizianagaram, Andhra Pradesh, or arbitration seated therein under the Arbitration and Conciliation Act, 1996.
